1. About These Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Client," "you") and SketchHaven, operated by Rajesh Kumar ("I," "me," "my," "Agent").

By using my website or services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Services Provided

SketchHaven offers professional real estate services in Mumbai, including but not limited to:

• Property buying assistance and consultation
• Property selling representation and marketing
• Rental property services (landlord and tenant representation)
• Market analysis and property valuation
• Investment consulting and portfolio advice
• Legal documentation support and coordination

Important: I act as a facilitator and advisor. Final decisions regarding property transactions remain with the client. I am not responsible for changes in property values, market conditions, or third-party actions.

3. Client Responsibilities

As a client engaging my services, you agree to:

• Provide accurate and complete information about your requirements
• Respond promptly to communications and requests for information
• Conduct yourself professionally during property viewings and meetings
• Inform me immediately if you engage other agents or find properties independently
• Honor agreed-upon commission structures and payment terms
• Verify all property details independently before making decisions
• Comply with all applicable laws and regulations

4. My Commitments

When you work with me, I commit to:

• Provide honest, professional, and timely service
• Act in your best interests within my capacity as an agent
• Maintain confidentiality of your personal information
• Disclose any known material defects or issues with properties
• Use reasonable efforts to find suitable properties or buyers
• Coordinate with legal professionals for proper documentation
• Keep you informed throughout the transaction process

5. Fees & Payment

Commission Structure

My services operate on a commission basis, typically:

• Property Sales: 1-2% of the final sale price
• Property Purchases: 1% of the purchase price
• Rentals: One month's rent (standard market practice)

Specific commission rates will be agreed upon in writing before services commence.

Payment Terms

• Commission is due upon successful transaction completion
• Payment should be made within 7 days of deal closure
• Accepted payment methods: Bank transfer, cheque
• Consultation fees (if applicable) are payable in advance

Refund Policy

Commission is earned upon successful completion of a transaction. If a deal falls through due to client withdrawal without valid reason after agreement, a cancellation fee may apply as outlined in the service agreement.

6. Property Information

I strive to provide accurate property information, however:

• Information is sourced from property owners, developers, and public records
• I cannot guarantee absolute accuracy of all details
• Clients are responsible for conducting independent due diligence
• Property inspections, legal verifications, and valuations are strongly recommended
• Market conditions and property availability change rapidly

Disclaimer: I am not liable for errors in property descriptions, measurements, or amenities unless caused by my intentional misrepresentation.

7. Website Use

Acceptable Use

When using my website, you agree NOT to:

• Use the site for any illegal or unauthorized purpose
• Scrape, copy, or download content without permission
• Transmit viruses, malware, or harmful code
• Impersonate me or any other person/entity
• Interfere with the website's functionality
• Use automated systems to access the site

Intellectual Property

All content on this website (text, images, logos, design) is owned by SketchHaven or licensed for use. You may not reproduce, distribute, or create derivative works without written permission.

8. Limitation of Liability

To the fullest extent permitted by law:

• I provide services "as is" without warranties of any kind
• I am not liable for market fluctuations or property value changes
• I am not responsible for actions of third parties (sellers, buyers, developers)
• My liability is limited to the commission earned on the specific transaction
• I am not liable for indirect, consequential, or punitive damages

Exception: Nothing in these Terms excludes liability for fraud, intentional misconduct, or violations of Indian consumer protection laws.

9. Dispute Resolution

In the event of a disagreement:

1. Direct Communication: We'll first attempt to resolve the issue through good-faith discussion
2. Mediation: If unresolved, we'll engage a neutral mediator
3. Arbitration: Disputes will be settled through binding arbitration in Mumbai
4. Legal Action: As a last resort, disputes fall under the jurisdiction of Mumbai courts

10. Termination

Either party may terminate the service agreement with written notice, subject to:

• Completion of ongoing transactions
• Payment of earned commission for work completed
• Return of confidential materials

I reserve the right to terminate services immediately if you breach these Terms or engage in unethical conduct.

11. Privacy & Data Protection

Your personal information is handled according to my Privacy Policy. By using my services, you consent to the collection and use of data as described therein.

12. Governing Law

These Terms are governed by the laws of India. Any legal action must be brought in the courts of Mumbai, Maharashtra. Indian real estate regulations, including RERA (Real Estate Regulatory Authority) rules, apply to all transactions.

13. Changes to Terms

I reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Continued use of services after changes constitutes acceptance of the modified Terms.

Significant changes will be communicated via email to active clients.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
